IT IS IMPORTANT THAT GUESTS CAREFULLY READ ALL TERMS OF THIS POLICY.
NOTICE: THE GUEST’S ATTENTION IS SPECIFICALLY DIRECTED TO THE CAPITALIZED TERMS IN SECTIONS 2.0, 2.1, 2.2, 4.0, 4.1, 4.2, 5.0 AND 6.0. SECTION 2.0 CONTAINS IMPORTANT LIMITATIONS ON THE GUEST’S RIGHT TO ASSERT LEGAL CLAIMS AGAINST OPERATOR, THE VESSEL, THEIR PARENTS, SUBSIDIARIES, AGENTS, EMPLOYEES, AND OTHERS.
This Guest Conduct Policy (hereinafter referred to as the “Guest Conduct Policy”) sets forth standards of conduct for Guests to follow throughout their cruise, including inside and around port terminals, while onboard, at ports of call and during shore excursions. This Policy helps ensure that all Guests enjoy a fun- filled, safe, and secure cruise experience. Operator requires Guest adherence to this Policy, which is also included and made a part of our Ticket Contract. Our Ticket Contract can be viewed on our website at the bottom of our landing page.
1.0 DEFINITIONS
“Operator” as used in this Guest Conduct Policy shall mean and include the Vessel, and all its owners, operators, parents, subsidiaries, employees, agents, and charterers. “Guest” shall include the plural where appropriate and means all persons or entities booking or purchasing passage and/or traveling under the Ticket Contract, including heirs, representatives, and any accompanying minors or young adults. The masculine includes the feminine. “Guest” shall have the same meaning as “Passenger.”
2.0 ENFORCEMENT OF THIS POLICY
In certain rare cases, Operator must unfortunately enforce this Guest Conduct Policy. IF OPERATOR EXERCISES THE AFOREMENTIONED RIGHT TO ENFORCE THIS GUEST CONDUCT POLICY, GUEST AGREES THAT HE/SHE/THEY SHALL HAVE NO CLAIM(S) AGAINST OPERATOR WHATSOEVER AND OPERATOR SHALL HAVE NO LIABILITY FOR REFUND,
COMPENSATION, LOSS OR DAMAGES OF GUEST OF ANY KIND WHATSOEVER FOR THE GUEST’S BOOKING OR CRUISE OR ANY ACCOMMODATIONS OR TRAVEL ARRANGEMENTS PRE- OR POST-CRUISE, INCLUDING BUT NOT LIMITED TO ANY EXPENSES INCURRED BY GUEST FOR ACCOMMODATIONS OR REPATRIATION. THIS POLICY SHALLY APPLY ONBOARD OUR VESSELS AND ASHORE IN AND AROUND OUR TERMINALS AND PORTS OF CALL.
2.1 COMPLIANCE
IT IS A CONDITION OF BOARDING AND REMAINING ONBOARD ANY OF OUR VESSELS THAT ALL GUESTS COMPLY WITH THIS GUEST CONDUCT POLICY AND ALL OF OUR HEALTH AND SAFETY POLICIES AND PROCEDURES. IN ADDITION, GUESTS ARE REQUIRED TO COMPLY WITH ALL APPLICABLE LAWS OF THE VARIOUS COUNTRIES THAT THEY VISIT.
FAILURE TO COMPLY WITH THIS POLICY, ANY OF OUR OTHER POLICIES, OR ANY INSTRUCTION COMMUNICATED BY US (INCLUDING OUR CREW) AT ANY TIME IN ANY FORM, WRITTEN OR ORAL, WILL BE CONSIDERED A BREACH OF THIS GUEST CONDUCT POLICY AND MAY RESULT IN ONE OR MORE ENFORCEMENT ACTIONS AS DESCRIBED BELOW, INCLUDING DENIAL OF BOARDING, OR REMOVAL FROM THE VESSEL WITHOUT ANY COMPENSATION OR REFUND. IN CERTAIN CIRCUMSTANCES OUR ENFORCEMENT ACTION(S) MAY RESULT NOT ONLY IN REMOVAL OF THE GUEST, BUT THE REMOVAL OF ALL OTHER PERSONS IN THE GUEST’S RESERVATION(S).
THIS GUEST CONDUCT POLICY IS SUBJECT TO THE CAPTAIN’S OVERRIDING AUTHORITY UNDER NATIONAL OR INTERNATIONAL LAW TO MAKE AND EXECUTE DECISIONS WHICH, IN THE CAPTAIN’S SOLE PROFESSIONAL JUDGEMENT, ARE NECESSARY TO MAINTAIN THE HEALTH, SAFETY AND SECURITY OF THE VESSEL.
2.2 ENFORCEMENT ACTIONS
A GUEST’S ACTUAL OR THREATENED VIOLATION OF THIS POLICY, ANY OF OUR OTHER POLICIES, OR ANY INSTRUCTION COMMUNICATED BY US (INCLUDING OUR CREW) AT ANY TIME IN ANY FORM, WRITTEN OR ORAL, OR OUR ASSESSMENT IN OUR SOLE DISCRETION THAT A GUEST’S PRESENCE ONBOARD CREATES A CONCERN OR RISK FOR THE HEALTH, SAFETY, OR SECURITY OF OTHER GUESTS, OUR CREW OR THE VESSEL MAY RESULT IN ONE OR MORE OF THE FOLLOWING ENFORCEMENT ACTIONS:
ANY OF OUR DETERMINATION(S), ASSESSMENT(S), JUDGMENT(S), DECISION(S), OR ENFORCEMENT ACTION(S) UNDERTAKEN BY US PURSUANT TO THIS POLICY SHALL BE IN OUR SOLE DISCRETION AND SHALL BE FINAL.
3.0 SAFETY AND SECURITY
Guests will undergo a security screening prior to boarding the vessel at the beginning of the cruise and at ports of call, and at any time where we may, in our sole discretion, require such security screening during the voyage. 3.1 MANDATORY SAFETY DRILL
Guests shall attend the mandatory safety drill (the “Muster”) and follow all health and safety instructions issued by the Captain. Upon embarkation, Guests must (a) review essential safety information and (b) report to their designated Muster station.
3.2 GUESTS’ REPORTING OBLIGATION
Guests must immediately report illness, injuries, unsafe or illegal behavior to the Vessel’s security personnel or other Vessel management. Guests can do so by calling or visiting the Guest Relations Desk, or by contacting the Vessel’s security personnel or other Vessel management wherever they are available.
A Guest’s failure to immediately report an illness, injury, unsafe or illegal behavior may impede the Vessel personnel’s ability to effectively respond. Any delay may also impede the Vessel’s ability to properly preserve information or evidence and may cause a delay in notifying the proper law enforcement or other government officials.
3.3 TAMPERING WITH FIRE DETECTION SYSTEMS AND FIREFIGHTING EQUIPMENT
We reserve the right to take action against any Guest found to have tampered and/or interfered with any fire detection equipment on the Vessel, including but not limited to smoke detectors in public areas and suites, break glass points, exit signs, fire safety doors, fire alarms, and fire extinguishers.
4.0 HEALTH
We have policies and procedures in place consistent with government, regulatory and public health guidance to ensure that we are providing a safe and healthy environment to all Guests.
GUESTS AGREE TO REVIEW AND COMPLY WITH ALL OF OUR HEALTH AND SAFETY INSTRUCTIONS, OR OTHER POSTED SIGNAGE. FAILURE TO DO SO MAY LEAD TO DISCIPLINARY ACTION(S), WHICH MAY INCLUDE BEING DENIED BOARDING OR REMOVAL FROM THE VESSEL.
WE RESERVE THE RIGHT TO DENY BOARDING TO ANY GUEST EXHIBITING SYMPTOMS OF COMMUNICABLE DISEASE(S) OR WHOSE HEALTH SCREENING RESULTS SHOW THEY MAY HAVE CONTRACTED SUCH A DISEASE(S). BOARDING MAY ALSO BE DENIED TO GUESTS WE DEEM, IN OUR SOLE DISCRETION, TO BE A CLOSE CONTACT OF ANY GUEST EXHIBITING SYMPTOMS OF A COMMUNICABLE DISEASE.

4.1 MANDATORY PREBOARDING TESTING AND SCREENING
We may conduct mandatory health screenings prior to boarding. Health and safety procedures will be in place during the boarding process. Guests shall comply with all procedures, signs, and instructions prior to embarking the Vessel. Guests must provide accurate information at all times. Guests shall cooperate with us, our agents, or service providers, during any attempt to obtain health information and/or carry out any health-related function.
GUESTS WHO REFUSE TO PROVIDE HEALTH INFORMATION OR WHO WILLFULLY PROVIDE INACCURATE HEALTH INFORMATION TO OUR MEDICAL TEAM AS PART OF A HEALTH SCREENING OR HEALTH ASSESSMENT MAY BE DENIED BOARDING, QUARANTINED OR SUBJECT TO OTHER DISCIPLINARY ACTION(S).
4.2 REPORTING OBLIGATION FOR ALL SYMPTOMS OF COMMUNICABLE DISEASE(S)
GUESTS EXPERIENCING ANY SYMPTOMS OF ANY COMMUNICABLE DISEASE, HOWEVER MILD, MUST IMMEDIATELY RETURN TO THEIR SUITE AND REPORT THE ILLNESS TO THE VESSEL’S MEDICAL PERSONNEL BY CALLING THE ONBOARD MEDICAL FACILITY. FAILURE TO IMMEDIATELY REPORT A COMMUNICABLE DISEASE OR ITS SYMPTOMS, OR WILLFULLY FAILING TO ACCURATELY REPORT SYMPTOMS IS A VIOLATION OF THIS POLICY AND GUESTS MAY BE SUBJECT TO DISCIPLINARY ACTION, INCLUDING BUT NOT LIMITED TO DEBARKATION.
4.3 QUARANTINE
Guest may be confined to his/her/their suite or placed in quarantine to avoid a communicable disease or other contagious condition from spreading to other Guests. We may require Guests to move to a new suite that has been set up specifically for isolation/quarantine. Guests must comply with all instructions given by crew during the period of isolation/quarantine and fully cooperate with crew throughout the disembarkation procedure.
4.4 HAND WASHING
Guests must wash their hands with soap and hot water after using the restroom and before eating or handling food. Hand washing thoroughly for at least 20 seconds with soap and hot water after using the restroom and before eating or handling food can help prevent contagious illnesses from starting and/or spreading.
5.0 GUEST CONDUCT
GUESTS AGREE TO REVIEW AND COMPLY WITH ALL OF THE BELOW GUEST CONDUCT REQUIREMENTS AND INSTRUCTIONS. FAILURE TO DO SO MAY LEAD TO DISCIPLINARY ACTION(S), WHICH MAY INCLUDE BEING DENIED BOARDING OR REMOVAL FROM THE VESSEL.
5.1 GOVERNMENT REQUESTS
If a Guest is required to take any action by a government entity, government official or government regulations and laws and Guest does not follow such directives, instructions and/or regulations, he/she will be in violation of this Policy.
5.2 SEARCH OF GUEST OR PROPERTY
If a Guest refuses to permit search of his or her person or property, then he/she will be in violation of this Policy.
5.3 REQUEST FOR PROOF OF IDENTITY
If a Guest refuses to produce identification on request, then he/she will be in violation of this Policy.
5.4 FAILURE TO COMPLY WITH RULES OR CRUISE TICKET CONTRACT
When a Guest fails and/or refuses to comply with: (1) any directive from the Captain; (2) any of the Operator rules or regulations and/or this Policy; or (3) any term of the applicable Ticket Contract, then he/she will be in violation of this Policy.
5.5 GUEST’S CONDUCT OR CONDITION
It is Operator’s policy that our Guests and crew have the right to be treated with dignity and respect. Operator may refuse to accept a booking request from a Guest, refuse to allow a Guest to board a vessel or remove any Guest from its vessel or port facilities, when such refusal to book or removal of the Guest is reasonably necessary in Operator’s sole discretion for the Guest’s safety, for the comfort or safety of other Guests or Operator employees and crew, or for the prevention of damage to the property of Operator and/or its Guests, employees or crew. Operator reserves the right to retain your credit card and/or debit card details as presented at registration and Guest agrees and authorizes his/her/their credit /debit cards to be charged in such amounts as Operator shall, in its sole discretion, deem necessary to compensate or make good the cost or expenses incurred for any detention or removal of a Guest or send an invoice to Guest’s registered address for any amount we incur for detainment or removal. Depending on the severity of the Guest’s actions, law enforcement may become involved at our sole discretion. By way of example, and without limitation, Operator may refuse to book/transport or may remove Guest from its port terminal and/or Vessel in any of the following situations:
5.7 ALCOHOL
Guests who violate any alcohol policy, including but not limited to underage drinking, providing alcohol to minors or young adults, or failing to consume alcohol responsibly, will be considered for discipline under the provisions of this Guest Conduct Policy and may be also debarked at any port at any time or not allowed to board, according to this Guest Conduct Policy. In such cases, no voyage and/or repatriation costs, airfare or any other expenses will be reimbursed. Operator reserves the right to revoke or otherwise restrict drinking privileges of any Guest, regardless of age. The Vessel’s crew may refuse to serve alcoholic beverages to any Guest who does not consume alcohol responsibly and may request verification of Guest’s age to determine whether he/she is of age to consume alcohol pursuant to this Guest Conduct Policy. The minimum drinking age for all alcoholic beverages on Operator’s vessel is 21. Guests who are 18-20 years of age can responsibly consume alcoholic beverages when the Vessel is in international waters (3 miles out of U.S. territorial waters).
5.8 NO SMOKING OR VAPING
No smoking or vaping is permitted onboard.
5.9 MINORS AND YOUNG ADULTS
A minor is defined as anyone under the age of 18. A young adult is defined as anyone between the ages of 18-20. All guest conduct policies apply equally to minors and young adults.
Parental and Guardian Supervision
Parents and guardians are responsible for the behavior and appropriate supervision of their accompanying minor(s) and young adult(s) throughout their cruise. This obligation applies inside terminals, while onboard, at our ports of call, and during shore excursions. This responsibility applies at all times, regardless of whether the parents and guardians are physically in the company of their minor(s) and young adult(s).
Disembarking the Vessel
Under no circumstances should the parent or guardian of a minor or young adult debark the Vessel without their accompanying minor(s) or young adult(s) or without having made arrangements for the accompanying minor(s) or young adult(s) appropriate supervision on the Vessel during their absence.
Public Areas
Guests under 18 years of age must be accompanied by an adult in their traveling party in all public areas of the Vessel.
Curfew
Guests under 18 years of age who are not accompanied by an adult in their traveling party, 21 years of age or older, must be clear of all public areas by 11:30pm. All guests under the age of 18, regardless of the presence of an adult in their traveling party must be clear of all public areas by 1am.
Spa
Guests under 18 years of age are not permitted in the spa.
Fitness Center
Guests under 18 years of age are not permitted in the fitness center.
Jacuzzi
Guests under 18 years of age are not permitted to use the jacuzzi.
Pool
Guests under the age of 18 may use the pool only in the presence of an adult in their traveling party (21 years or older). Guests under 18 years of age may only use the pool during the approved and posted young adult and minor hours. These hours are very limited. While enjoying the pool areas, we ask that Minors and Young Adults refrain from running to ensure a safe and pleasant environment.
Shore Excursions
Guests under 18 years of age must be accompanied by an adult in their traveling party (21 years or older) to participate in shore excursions. Some excursions require a minimum age to participate and will be noted accordingly.
Respectful Play
Minors and Young Adults are welcome to play and have fun in designated areas. Running, jumping, or playing games that could disrupt the comfort of other guests in non-designated areas are not permitted.
Volume Control
We understand that excitement can sometimes get the best of us; however, we ask that Minors and Young Adults use indoor voices in public areas to maintain a tranquil atmosphere for all guests. Shouting and loud noises are to be avoided.
Dining Decorum
During mealtimes in our dining areas, we encourage Minors and Young Adults to remain seated and follow the etiquette expected in a luxury dining setting. Our staff is delighted to assist in making the dining experience enjoyable for our Minors and Young Adults.
Elevator Courtesy
Please prioritize the use of elevators for guests with mobility needs. Minors and Young Adults are to enter and exit elevators calmly and are not to play with the elevator buttons.
Furniture Care
Our furnishings are selected for your comfort and enjoyment. We ask that Minors and Young Adults not climb on or jump off furniture to prevent damage and potential injuries.
5.10 GUEST AND CREW INTERACTION
Crew members are prohibited from engaging in physical relationships with Guests. Crew members are not permitted to socialize with Guests beyond their professional duties, and are not permitted to be in Guest suites, except for the performance of their shipboard duties. Guest agrees to respect these policies and is similarly prohibited from engaging in physical relationships with crew members. Guests are not permitted in any restricted or crew area of the Vessel, including crew suites and corridors.
5.11 PROHIBITED ITEMS
Guest will be subject to disciplinary action pursuant to this Guest Conduct Policy if he/she is found to have brought onboard any Operator Vessel any of the following prohibited items, including:
5.12 CHARGES FOR GUEST’S REMOVAL OF OPERATOR PROPERTY
We reserve the right to charge, and Guest hereby authorizes Operator to charge, Guest’s credit/debit card in such amounts as Operator shall in its sole and reasonable discretion deem necessary for the cost of replacing any items that Guest removes from the premises of the Cruise Terminal or the Vessel without Operator’s written consent or without a receipt for purchase of same. The charge will be the full replacement amount of the missing item, including any shipping charges. If we discover any item missing after the Guest has disembarked the Vessel, we reserve the right to charge, and Guest hereby authorizes Operator to charge, Guest’s credit /debit card in such amounts as Operator shall in its sole and reasonable discretion deem necessary.
5.13 GUEST MAY BE CHARGED/BILLED FOR PROPERTY DAMAGE
Guest is liable for any damage caused whatsoever of any kind to Operator’s property, including the Vessel, ports of call, and/or the Cruise Terminal premises. Operator reserves the right to charge Guest the cost of rectifying such damage by retaining Guest’s credit card/debit card details as presented at registration and Guest hereby authorizes Operator to charge Guest’s credit/debit card in such amounts as it shall in its sole and reasonable discretion deem necessary to compensate or make good the cost or expenses incurred or suffered by Operator as a result of the damage. Should this damage be discovered after the Guest has disembarked, we also reserve the right and Guest hereby authorizes Operator to charge Guest’s credit/ debit card for any damage incurred to your suite, the Vessel, port of call, and/or the cruise terminal, including and without limitation for all property damage, missing or damaged items, smoking fees, and cleaning fees. In the alternative, Operator may issue Guest an invoice for such damages. We will make every effort to rectify any damage internally prior to contracting any specialists to make the repairs and will make every effort to keep any costs that the Guest would incur to a minimum. In severe cases, Guest will be liable for any loss of revenue that Operator suffers while the Guest’s suite is being repaired and/or restored so that it can be used for other Guests again.
6.0 MODIFICATIONS OF THIS POLICY
This Policy shall remain in full force and effect until Operator chooses, in its sole discretion, to update or modify all or part of this Policy. Updates or modifications to this Policy may be made and shall be effective without publication, although we will endeavor to post any updates or modifications to this Policy in a timely manner and to a publicly accessible forum, including but not limited to the Operator website.
